SEFWI-WIAWSO : Court dismisses case against Minister and DCEs

The High Court in Sefwi Wiawso, presided over by Mr Justice K. B. Aning, has dismissed an application for interim injunction filed by about 30 former caterers of the Ghana School Feeding Programme (GSFP) against the Western Regional Minister and District Chief Executives (DCE) in that region.

The High Court in Sefwi Wiawso, presided over by Mr Justice K. B. Aning, has dismissed an application for interim injunction filed by about 30 former caterers of the Ghana School Feeding Programme (GSFP) against the Western Regional Minister and District Chief Executives (DCE) in that region.
   
Mr Kwadwo Owusu Afriyie, counsel for the plaintiffs, filed the application, seeking to restrain the Western Regional Minister and all DCEs from interfering with the contracts awarded to caterers appointed by the NPP under the GSFP.
   
Mr Justice K.B Aning, in his ruling, said it was act of bad faith for the plaintiffs to have bypassed the Sekondi High Court to Sefwi Wiaswso to file an application for interlocutory injunction against high public officials.
  
In effect Justice K. B. Aning upheld the Attorney General’s objection to the jurisdiction of the Sefwi Wiawso High Court.
  
According to the Judge, of the three High Courts in the Western Region at Sekondi, Tarkwa and Sefwi Wiawso, the High Court at Sekondi is the best forum for the plaintiffs to initiate their action.
   
He therefore directed of Registrar to forward the docket on the matter to the Chief Justice for further directives with the view to having the case transferred to the Sekondi High Court.
   
The case is therefore no longer pending before the High Court at Sefwi.
   
The judge made no order as to cost.
  
It would be recalled that Mr Afriyie, alias Sir John, was also the counsel for plaintiffs who lost a similar case in Kumasi when they sued the Ashanti Regional Minister, his deputy and all 39 DCEs.
